MOSCOW. Nov 15 (Interfax-AVN) - The Russian State Duma has voted to reanimate correctional custody in the armed forces, and backed draft amendments proposing that this practice be enforced from January 1, 2007 in their third and final reading.
Correctional custody will be applied for military disciplinary offenses to servicemen and those undergoing military training.
The accused will receive the benefit of any doubt about his guilt.
The commander will be given ten days to gather evidence and submit it to the garrison military court which is to decide whether correctional custody should be applied.
The law says which circumstances must be cleared if the procedure is to be applied, and lists the rights of servicemen disciplined. The person under scrutiny must not be humiliated or treated rudely, and the punishment must not entail physical suffering, the law says.
