Refusal to hear motion on transfer of Whelan, convicted of espionage, to U.S. lawful - Appeal Court

NIZHNY NOVGOROD. Nov 8 (Interfax) - The Fourth Appeal Court of General Jurisdiction in Nizhny Novgorod has found lawful the refusal of the Supreme Court of Mordovia to hear a motion on the transfer of U.S. citizen Paul Whelan, convicted of espionage in Russia, to the United States to serve his remaining time in prison.

"The judgement of the Supreme Court of Mordovia, which dismissed the application to transfer Paul Whelan to the United States without processing it, is now upheld, and the appeal from the defense has been dismissed," Judge Nikolai Volkov said.

Whelan's lawyer said after the hearing that the judgement would be challenged in a cassation court, and an application might be filed with the European Court of Human Rights.

"We believe that Paul has actually been denied justice, to which everyone is entitled," the lawyer said.
